The Controlled Substances Act (“CSA”), 21 U.S.C. § 841, prohibits dispensing controlled substances, unless prescribed “for a legitimate medical purpose by an individual practitioner acting in the usual course of his professional practice.” 21 C.F.R. § 1306.04(a). Dr. Sharon Johnston was convicted for illegally dispensing: Oxyco-done (the generic name for Roxicodone) and Alprazolam (the generic name for Xa-nax) (Count 1); Oxycodone (Count 2); A-prazolam and Methadone (Count 3); and Oxycodone (Count 4) in violation of 21 U.S.C. §§ 841(a)(1) and (b)(1)(C). 1 She was sentenced to 30 months’…
