In May, 1922, the appellee, J. C. Oehler, was struck and injured by an engine belonging to the International Great Northern Railway Company, on one of the street crossings in the city of Palestine. At that time the railroad was in the hands of James A. Baker as receiver, appointed by the federal court for the Southern District of Texas. In July, 1922, the railway property, together with its charter and franchises, was sold under an order of foreclosure entered in that court.
