PROCEDURAL HISTORY/ISSUES
Margaret Conway (Margaret) brought this action for an equitable accounting of rental income received from jointly-owned real property located in Minnehaha County. Trial court granted a partial summary judgment to Gerald Conway (Gerald).
Margaret appeals and raises the following issues on appeal:(1) Does the applicable statute of limitations and/or doctrine of laches bar Margaret’s action? We hold the statute of limitations is tolled because of fraudulent concealment.(2) Did the trial court err in denying Margaret’s motion for summary judgment?
