This is a proceeding wherein it is sought by mandamus to compel the circuit court of Minnehaha county to ■dismiss an appeal from the county court of Minnehaha county to the circuit court of that county.

On December 3, 1932, the county court of Minnehaha county made an order admitting to probate in that court a certain instrument as and for the last will and testament of Endre J. Vasgaard, deceased, and appointing executors thereof.
