The defendants1 appeal from the judgment, after a trial to the court, awarding the plaintiff damages and attorney’s fees under 42 U.S.C. § 1983. *53In his cross appeal, the plaintiff claims that the trial court erred in its calculation of damages, and he further asserts that he is entitled to a new trial regarding damages if the defendants prevail on their appeal. The dispositive issue is whether the trial court erred in concluding that the plaintiff alleged and proved a cause of action under 42 U.S.C. § 1983, and in awarding damages and attorney’s fees therefor.
