This appeal is from a judgment of dismissal entered after demurrers had been sustained to the five counts set forth in plaintiffs’ first amended complaint. Before us also is respondents’ motion to dismiss the appeal which was continued to be heard and submitted at the time of the hearing and submission of the appeal.
