Appeal from a judgment of the County Court of Rensselaer County (Sheridan, J.), rendered August 25, 1998, upon a verdict convicting defendant of two counts of the crime of criminal sale of a controlled substance in the third degree.
Defendant’s first challenge to his conviction, arising from his involvement in two narcotic sales to undercover State Police Investigators in the City of Troy, Rensselaer County, alleges that County Court erred in denying his motion to suppress in-court identification testimony which was the result of an unduly suggestive photo array.
