Plaintiff Equal Employment Opportunity Commission (the “EEOC”) brings this action against defendant Incorporated Village of Valley Stream (“Valley Stream”) alleging that between 1992 and 2003 Valley Stream discriminated against active volunteer firefighters age 65 and older by not allowing them to accrue credit toward a “service award” — a form of retirement benefit — because of their age, in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq.
