Appeal from an order of the Supreme Court (Dowd, J.), entered July 18, 2005 in Chenango County, which denied defendants’ motion for summary judgment dismissing the complaint.
Plaintiff Dimitrios Spiratos (hereinafter plaintiff) worked in the kitchen while an inmate at defendant Chenango County Correctional Facility (hereinafter the facility). One of his duties included the preparation and distribution of hot water to the other inmates.
