ROY, District Judge.
Pending before the Court are motions for summary judgment which have been filed by both the plaintiff and the defendant. The parties have agreed to waive their right to a trial and have advised the Court that all of the issues pending may be decided on the briefs which have been filed in connection with the motions for summary judgment.
