BEACH, J.

The defendant, Laura Shelby-Posello, has appealed from the judgment of the trial court rendered *385in favor of the plaintiff, the city of Norwich, in its summary process action. The plaintiff moved to dismiss the defendant’s appeal because the defendant failed to provide the bond required by General Statutes §§ 47a-35 and 47a-35a.1 We concluded that the appeal should be dismissed unless the defendant filed a motion to set a bond or a motion for use and occupancy payments in lieu of a bond pursuant to § 47a-35a.2
