HAMLIN, Justice:

In the exercise of our supervisory jurisdiction we directed certiorari to the Court of Appeal, Fourth Circuit, for review of its judgment which affirmed the judgment of the trial court. After considering the verdict of the jury, the law,, and the evidence, the trial court rendered judgment: (a) in favor of plaintiff, Louise M. Bur-, dine, Wife of Henry Eschmann (as sur*821viving spouse),1 (hereinafter referred to as either Louise M. Burdine or Mrs. Eschmann), and against the defendants, R.
