Thiele, J.:

This was an, action to recover the value of crops raised by die plaintiff under a leasing contract with the defendant and for damages for breach of the contract by the defendant. As a result of motions made by the defendant the plaintiff filed an amended petition. Defendants demurrer to the amended petition, hereafter called the petition, on the sole ground facts sufficient to constitute a cause of action were not stated, was overruled and he has appealed, assigning the ruling as error.
