The first question presented by the appeal is, whether the plaintiff is in a situation to inquire into the validity of the deed made by Charles Barrett to his daughter Xarifa Jane, on the 4th of February, 1868. Was she a creditor, or did she have a lawful suit or demand against said Charles Barrett, at that time, within the meaning of § 51, Chapter 6 of Miscellaneous Laws ?
