We will refer to plaintiffs in error as Dollisons and to defendants in error as the contractors.

The action was commenced by the contractors who alleged in their complaint that they had constructed a building on lands owned by Dollisons under an agreement by which the latter agreed to pay all costs of construction plus ten per cent of such costs to the contractors. It was further alleged that the cost of construction plus ten per cent amounted to the total sum of $27,283.00 and that Dollisons had paid on account thereof the sum of $16,500.00, leaving a balance of…
