Appeal from a judgment of the County Court of Ulster County (LaBuda, J), rendered March 19, 1999, upon a verdict convicting defendant of the crime of aggravated harassment of an employee by an inmate.

On October 21, 1997, defendant was housed in the special housing unit for high-risk inmates at the Shawangunk Correctional Facility in Ulster County. Ralph Rohl and Laura Giordano, both correction officers, were delivering meals to inmates.
