I. INTRODUCTION

Plaintiff Drug Reform Coordination Network, Inc., brought this action against Defendant Grey House Publishing, Inc., alleging that Grey House sent it an unsolicited facsimile advertisement in violation of the Telephone Consumer Protection Act of 1991. 1 Grey House has moved to dismiss Plaintiffs Second Amended Complaint on the ground that the facsimile at issue does not meet the Act’s definition of “unsolicited advertisement.” The court disagrees and denies Defendant’s Motion.
