This matter is before the Court on defendant’s motion to dismiss for failure to state a claim upon which relief may be granted pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. 1 Plaintiffs Sarah Bourbeau and the Equal Rights Center (“ERC”) allege that defendant violated and continues to violate the District of Columbia Human Rights Act, D.C.Code §§ 2-1401.01 et seq.
