OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

Appellant was convicted in a jury trial of burglary of a habitation with one prior conviction. The jury assessed punishment at 25 years confinement.

On February 16,1983, the Dallas Court of Appeals affirmed appellant’s conviction in an unpublished, per curiam opinion.

Appellant petitioned this Court to consider whether the Court of Appeals erroneously overruled his second ground of error which complained of the prosecutor’s improper jury argument at the close of the guilt/innocence phase of the trial. The Court of Appeals…
