MORRIS, District Judge.

This is an action at law brought by the plaintiff, Geraty, against the railroad company to recover damages for losses on early cabbages shipped, or intended to be shipped, from a station on the railroad called Meggets, in South Carolina, and destined for places in the West in the month of May, 1905. It is claimed that for proper transportation of the cabbages the only proper cars were refrigerator cars, and that the railroad failed to furnish refrigerator cars, although seasonably notified by the plaintiff; and that in consequence the cabbages which were shipped, being…
