George P. Green & Company sued Central of Georgia Bailway Company for failure to furnish promptly a car requested by the plaintiff for a shipment of peaches. The defendant filed a general and special demurrer, which the court overruled. At the trial the plaintiff amended the petition, after which the defendant made a motion to dismiss, which was also overruled. After verdict *796for the plaintiff, the defendant moved for a new trial; and this being refused, the defendant excepted.
