Before the Court are Defendants’ Motion to Dismiss (Dkt.9), Defendants’ Motion to Strike Plaintiffs statement of facts (Dkt. 14), and Plaintiffs responses thereto.
BACKGROUND
Plaintiff initiated this action on April 24, 2007, alleging breach of contract, unfair competition, and trademark infringement under state and federal law.
