OPINION
HORN, Judge.
The above captioned case is presently before this court on cross motions for summary judgment pursuant to Rule 56 of the Rules of the United States Court of Federal Claims (RCFC). The plaintiff, Donnie E. Price, through counsel, alleges that the defendant, the United States government, acting through the United States Department of Veterans Affairs (VA), committed a breach of contract by failing to be able to deliver certain property in the condition it was in at the time the parties entered into the Installment Contract to purchase the property.
