MAHONEY, Circuit Judge:

Defendant-appellant Angel Marquez appeals from a judgment entered in the United States District Court for the Southern District of New York, Kevin Thomas Duffy, Judge, following Marquez’ plea of guilty. The indictment charged that Marquez possessed with the intent to distribute heroin on or about December 18, 1989 in violation of 21 U.S.C. §§ 812, 841(a)(1), and 841(b)(1)(C) (1988). Marquez was sentenced to a term of twelve months imprisonment, to be followed by a twenty-year term of supervised release. The district court also imposed a fine in the amount of $100,000,…
