Defendants Enrique Reinaldo Rivera and Samuel Aponte-Vega appeal from judgments entered in the United States District Court for the Southern District of New York, following a jury trial before Kevin Thomas Duffy, Judge, convicting each of them on one count of conspiring to distribute heroin, in violation of 21 U.S.C. § 846 (1988), and two counts of maintaining premises for the purpose of manufacturing and distributing heroin, in violation of 21 U.S.C. § 856(a)(1) (1988) and 18 U.S.C. § 2 (1988); convicting Rivera on one count of engaging in a continuing criminal…
