Reversing.

This appeal is from a judgment of the McCreary circuit court awarding to the appellee, John C. Minton, against the appellant, Kentucky & Tennessee Railway Company, the sum of $8,000.00. In hereinafter referring to the parties we shall do so by the terms “plaintiff” and “defendant.” The cause of complaint, as made by the plaintiff in his petition against the defendant, appelllant, and the Cincinnati, New Orleans & Texas Pacific Railway Company, which latter company is not a party to this appeal, is, that through their negligence, the plaintiff, who…
