Anthony Avery Baker was charged in a two-count indictment with burglary in the second degree, in violation of §13A-7-6(b), Code of Alabama 1975, and attempted rape, in violation of § 13A-6-61 and § 13A-4-2, Code of Alabama 1975. In a separate indictment, the appellant was indicted for burglary in the second degree, in violation of § 13A-7-6(b), Code of Alabama 1975. The two cases were consolidated for trial.
