I. INTRODUCTION

This matter comes before the Court on the Motion of Carl F. Hughes, as guardian for Martin J. Hughes, Jr. (“Plaintiff’), to Dismiss and for Partial Summary Judgment against Defendant American Mutual Share Insurance Corporation (“ASI”), in its capacity as Conservator for the United Telephone Credit Union (“UTCU”). For the following reasons, Plaintiffs Motions are GRANTED.
