In a proceeding to commit appellant for violation of an order of protection of the Family Court, Suffolk County, dated October 9, 1970, the appeal is from an order of said court dated May 20, 1971, which denied his motion to dismiss the application. Order reversed, on the law, without costs, and petition dismissed. Petitioner and appellant live together as husband and *547wife and are the parents of a child. However, they have never married.
