FACTUAL BACKGROUND

This matter comes before the court upon plaintiffs petition to amend the complaint.

Plaintiff brings this action to recover for damages resulting from a fire in plaintiffs senior high school building on or about March 13, 1978. Plaintiffs original complaint, filed February 27, 1980, consists of three counts. Count I, in trespass, alleges defective manufacturing, supply and distribution of Soundmaster 160 folding partitions.
