OPINION AND ORDER

This matter is before the court on the motion of defendants Robert H. Hovis, III, and Robert H. Hovis, III, P.C. (“Hovis,” collectively), to dismiss counts II through VI of the complaint for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6), and Hovis’s motion for a more particular statement of fraud pursuant to Rule 9(b).
