This is an appeal from the judgments in three separate actions, all of which arose out of the construction of an irrigation system on certain farm property. One of the defendants, Associated Farm Management, Inc. (AFM), contends the trial court erred by failing to award it costs and attorney fees in one of the actions, where it was the “prevailing party.” In the published portion of this opinion, we determine AFM waived its rights to costs and attorney fees.
