MEMORANDUM AND ORDER
CROW, Senior District Judge.
The case comes before the court on the defendant’s motion to confirm the arbitration award and for summary judgment (Dk. 10). The case arises from a dispute that began when the plaintiff continued to find termite activity after the defendant had retreated his home several times. The plaintiff asked the defendant to pay for the damages done to his home, and the defendant offered to make limited repairs.
