A. State Against Black Hawk
In June 1999, the Maine Department of Environmental Protection (DEP) conducted an expanded site assessment of the Kerramerican Mine Site located in Blue Hill, Maine (the Site). Am. Compl. at 9 (Docket #3). The assessment revealed that “the soils and sediments ... were all contaminated with hazardous substances .... ” Id.
