We granted the petition for a writ of certiorari filed by Ted's Game Enterprises ("Ted's") to address two issues.2 The first issue is whether Ala. Const. 1901, Art. IV, § 65, prohibits the Legislature from authorizing or legalizing coin-operated amusement machines as to which "some skill" influences "in whole or in part" the result obtained by the operation of the machines. The second issue is whether Ala. Code 1975, § 13A-12-76, may, without contravening Ala. Const. 1901, Art.
