Southeastern Pennsylvania Transportation Authority (SEPTA) appeals from an order of the Court of Common Pleas of Philadelphia County (trial court) denying SEPTA’s post-trial motions and entering judgment in favor of the plaintiff, Maurice Clark, for $131,-204.17.
On October 31, 1988, while riding on a SEPTA trolley, Clark was arrested by two SEPTA police officers. As the police officers attempted to move him from the trolley to the platform and to subdue him, a struggle ensued and Clark was hit and kicked by the officers.
