—Appeal from a judgment of the Supreme Court (Hemmett, Jr., J.), entered June 7, 1996 in Washington County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent calculating the length of petitioner’s sentence.

Petitioner was convicted of the crime of attempted burglary in the first degree and sentenced as a second felony offender to a prison term of lxh to 3 years in August 1993. While participating in the Temporary Release Program, petitioner committed another crime for which he was sentenced as a second felony offender…
