Memorandum: Petitioner was convicted of criminal sale of a controlled substance in the third degree and sentenced on January 7, 1994 to serve an indeterminate term of incarceration of 1 to 3 years. He was released from a correctional facility as part of a temporary work release program on February 2, 1994. He absconded on May 11, 1994.
