MEMORANDUM AND ORDER

This matter is before the Court to consider confirmation of the Debtor’s Second Amended Plan of Reorganization filed on February 13, 1986, and to consider the Motion to Dismiss, initially filed December 28, 1984, and renewed on February 3, 1986, by Farmers State Bank of Hawarden, Iowa (BANK). The Second Amended Plan has been accepted by the Class 2 creditor, First State Bank of Hawarden, Iowa, which holds a secured claim in the amount of $1,675.34.
