MEMORANDUM OPINION AND ORDER DENYING CONFIRMATION OF THIRD AMENDED PLAN OF REORGANIZATION

I.PRELIMINARY STATEMENT
This matter is before the Court following a hearing held to consider confirmation of the Third Amended Plan of Reorganization (“Plan”) filed in this Chapter 11 case.
