QUINN, Associate Judge.
Early on the morning of October 17, 1950, a fire occurred in an apartment directly above an apartment occupied by Zim-mer. Some of the water used to extinguish the fire seeped through the floor into Zim-mer’s apartment. Later that day Zimmer noticed that the ceiling in his living room had buckled in several places. He immediately notified appellant of this condition.
