Eduardo Kivera, hereinafter called plaintiff, brought suit against school district No. 48 of Maricopa county, and V. C. White, Walter Dunn and J. K. Steward, as trustees of said district, and also in their individual capacity, to recover damages for the destruction of a building belonging to plaintiff which was burned while used and occupied by the district.
