Error to the superior court of Grand Rapids; Dun-ham, J. Case by Elmer H. Daniels, an infant, by next friend, against the board of education of the city of Grand Rapids as a body and individually for injuries caused by alleged faulty construction of a balustrade in a schopl building. From an order sustaining defendants’ demurrer to the declaration, plaintiff brings error.

Plaintiff, a boy about 8 years of age, was severely injured while a pupil at the Sigsbee school in the city of Grand Rapids as the result of falling a distance of about 18 feet down a central, open space around which the stairway ran leading to successive stories from the basement to the top of the building, with a balustrade, over which he fell, about 30 inches high on the side exposed to the opening. This action to recover damages for injuries so sustained was brought in the superior court of Grand Rapids, by his father as next friend, against the board of education of the city of Grand…
