HAMITER, Justice.

Charged with the willful and unlawful possession of a narcotic drug (eleven marijuana cigarettes), the defendant, Christian Brauner, was tried by a jury, found guilty, and sentenced to five years at hard labor in the state penitentiary. From such conviction and sentence he appealed, relying for a reversal on one bill of exceptions. (Actually two bills were perfected; however, the second was taken to the overruling of a motion for a new trial which was *498based on the same grounds as those urged in the first.)
