Appeal from Smith. Tried below before the Hen. J. L. Henry, special judge. March 23, 1874, Peter G. Ragsdale brought an action of trespass to try title against Julius A. Robinson for one-third interest in 200 acres of land, part of the John W. Cauble 640 acres headright. The defendant pleaded not guilty, and limitation of three and five years. The parties also pleaded specially their titles, the various amendments covering about forty pages of the record.

This is an action of trespass to try title, brought by appellant, Ragsdale, against appellee, Robinson, for an undivided one-third of a tract of 200 acres of land, a part of a tract of 640 acres patented to John W. Cauble.
All the important questions in this case arise out of, and depend upon, the construction and effect to be given to an instrument purporting to be a deed from appellant to 1ST.
