In Teamsters Local 617 Pension & Welfare Funds v. Apollo Group, Inc., 633 F.Supp.2d 763 (D.Ariz.2009) (‘Apollo I”), the court issued a host of rulings pertaining to defendants’ motions to dismiss the First Amended Complaint (“FAC”) in this securities fraud action.
