The appellant, Clarence Kelly, and Michael Papadaches were jointly charged by indictment with the commission of three murders, each alleged in a separate count. Both defendants entered pleas of not guilty. Their separate motions for a severance were granted, and the record now before us relates only to the trial and appeal of the defendant Kelly. His demurrer to the indictment was overruled, and his motion to compel the prosecution to elect as to which charge in the indictment it would submit to the jury was denied.
