C. A. Settlemire, the appellee, brought suit against Daniel Lumber Company, a partnership, and the appellants Charles H. Daniel and Jack W. Daniel and three other individuals, both individually and as members of the partnership Daniel Lumber Company, and Kennie Chancey, for damages arising out of an automobile-truck collision in Montgomery County. The suit was dismissed as to certain of the individuals and the case went to trial with the appellants and Kennie Chancey as defendants.
