OPINION

TERRY JENNINGS, Justice.

A jury found appellant, Edward Espar-za, guilty of the offense of aggravated sexual assault.1 This Court, in an unpublished opinion, affirmed appellant’s conviction, but remanded for a new trial on punishment only.2 On remand, a second jury assessed punishment at confinement for life, and the Fourteenth Court of Appeals affirmed appellant’s sentence in an unpublished opinion.3 Subsequently, appellant filed a motion for post-conviction DNA testing, which the convicting court denied on September 27, 2005.4 In his sole point of error, appellant contends that the…
