BRIGHT, Circuit Judge.

Appellant Burt Beavers appeals from the district court’s dismissal of his petition for a writ of habeas corpus. He asserts that the Arkansas Habitual Offenders Act, Ark. Stat.Ann. §§ 41-1001 to -1005 (1977) (the “Act”), 1 is unconstitutional and that the district court erred in dismissing his petition without holding an evidentiary hearing on his allegations that the Act was diserim-inatorily applied against him and that he received ineffective assistance of counsel.
